LA PALAPA RENTALS
CONTRATO DE RENTA DE RZR, CAN-AM. - That celebrate, on the one hand, the business LA PALAPA RZR & ATV RENTALS, and on the other hand, THE CUSTOMER, who agrees on the rent consisting of:
UNDER THE FOLLOWING CONDITIONS OR REGULATIONS FOR ITS USE:
- Shall be driven by people of legal age, and he/she shall have a driver's license
- Obey all traffic signals and use the helmet given as a protective measure
- Do not carry more than 4 people per RZR or Can-Am
- Do not put the unit(s) into water, mud, or the sea water
- Do not drive in the mountain called La Choya
- Do not consume alcohol, drugs or substances that may prevent you from having full physical and mental capacity
- The unit shall be delivered at the agreed time, any delay generates extra cost
- There is no refund for delivering the unit before the agreed time
EXTRA PAYMENT FOR DAMAGES:
- For putting the unit in water or mud from $500.00 DLLS
- Broken bars due to mishandling, crash or rollover $500.00 DLLS each
- Damages in general caused by mishandling, crash or rollover start at: RZR or CAN-AM starting at $4,000.00 DLLS per service up to $38,000.00 DLLS for complete loss plus damages
LIABILITY. - THE CUSTOMER drives at his/her own risk, LA PALAPA RENTALS, has not contracted any insurance policy for civil liability or damages, therefore, THE CUSTOMER:
- is fully responsible and is bound to respond including and excludes for any damages or accident (including death) caused by mishandling, crash or rollover, by him/her or by the people he/she allows to drive the unit during the time of rental of the unit or while it is in possession, whether to third parties involved traveling in the unit or not, or to him/herself.
- Is bound and agrees to respond for any mechanical and physical damages caused to the rental unit, or to any other involved.
- Is bound and agrees to respond for damages caused to public or private property, as well as violations of traffic regulations
- The insurance policy that the customer may have for his/her private vehicle does not apply to the rented unit nor does it cover damages caused.
WARRANTY. - THE CUSTOMER as a guarantee that he/she will be liable for all damages that could be caused by mishandling, collision or overturning; in this contract, gives as deposit and guarantee the vehicle with the following characteristics ____________; same that will be returned to cover the total cost of the damage(s) caused.
The customer declares to have read and fully acknowledges the content of this contract, in Puerto Penasco, Sonora on the [date] ; therefore, it is recorded by signing at the bottom of this document.
LA PALAPA RENTALS
CONTRATO DE RENTA DE MOTOS, RHINOS. - Que celebran por una parte, el negocio comercial LA PALAPA RZR & ATV RENTALS, y por otra parte, EL CLIENTE, quienes pactan la renta consistente en: Moto.
BAJO LAS SIGUIENTES CONDICIONES O REGLAMENTO DE USO:
- Deberá ser conducida por personas mayores de edad y que cuente con licencia de manejo
- Obedecer todas las señales de tránsito y usar el casco otorgado como medida de protección
- No subir más de 4 personas
- No meter las unidades a agua, lodo, o al mar
- No conducir en la montaña denominada La Choya
- No consumir alcohol, drogas o sustancias que puedan impedir tener plena capacidad física y mental
- La unidad deberá ser entregada en la hora acordada, cualquier retraso genera costo extra
- No hay reembolso por entregar la unidad antes del tiempo acordado
PAGO EXTRA POR DAÑOS:
- Por meter la unidad al agua o lodo desde $500 DLLS
- Por daños generales ocasionados por mal manejo, choque o volcadura: barras desde los $200 DLLS por servicio más los daños ocasionados; Rhinos desde $1,500 DLLS por servicio más los daños ocasionados
RESPONSABILIDAD. - EL CLIENTE conduce bajo su propio riesgo. LA PALAPA RENTALS no tiene contratada ninguna póliza de seguro por responsabilidad civil ni daños; por lo tanto, EL CLIENTE:
- Se hace totalmente responsable y se compromete a responder en forma exclusiva y excluyente de cualquier accidente (incluyendo la muerte), ocasionado por mal manejo, choque o volcadura, por sí, o por las personas a las que se le permita conducir la unidad durante el lapso de la renta de la unidad o mientras esté en su poder, ya sea a terceras personas involucradas viajen o no en la unidad, o a sí mismo.
- Se hace responsable y se compromete a responder por los daños mecánicos y físicos ocasionados a la unidad rentada y a cualquier otra involucrada.
- Se hace responsable y se compromete a responder por los daños causados a propiedad pública o privada, así como infracciones al reglamento de tránsito.
- La póliza de seguro que el cliente posee de su vehículo particular no aplica en la unidad rentada ni cubre daños ocasionales.
GARANTÍA. - EL CLIENTE como garantía de que responderá por todos los daños que pudiera ocasionar por mal manejo, choque o volcadura, mediante este contrato deja en depósito y garantía el vehículo con las siguientes características ____________; mismo que se devolverá al cubrir el costo total de los daños ocasionados.
El cliente declara haber leído y entendido en su totalidad el contenido del presente contrato, en Puerto Peñasco, Sonora, el [fecha]; por lo que lo hace constar mediante su firma al calce del presente documento.
